These Terms of Service ("Terms") govern the access and use of the services provided by Proficiency Background Screening, LLC ("PBS," "we," "us," or "our"). By accessing our platform, purchasing single-transaction vetting operations, onboarding verification streams, or utilizing our Third-Party Administration (TPA) services, the Client ("you") agrees to be legally bound by these terms without limitation or exception.

As an accredited Consumer Reporting Agency (CRA), PBS operates under the strict legal mandate of the Fair Credit Reporting Act (FCRA). Use of our data intelligence assets is contingent upon absolute validation of the following certifications:
The Client certifies that it will only request consumer reports for a distinct "Permissible Purpose" as defined by Section 604 of the FCRA. The Client further certifies that it will provide clear and conspicuous written disclosures to candidates and obtain explicit written authorization prior to triggering any screening request sequence.
All data transmitted through the PBS infrastructure is secured via AES-256 cryptographic encryption protocols. Both parties agree to maintain strict PII (Personally Identifiable Information) handling guidelines, secure local workstations, and follow SOC 2 Type II framework paradigms to ensure 100% audit readiness.
PBS provides data intelligence and verification tracking derived from primary repositories, including county courts, state DMVs, federal registries, and biometric databases. While we maintain an absolute accuracy mandate across our processing streams, PBS shall not be held liable for administrative delays, record entry mistakes, omissions, or processing timelines native to government court-clerk spaces, state repositories, or public background registries. We do not render definitive legal opinions; the Client assumes full responsibility for all hiring, retention, onboarding, and internal adjudication decisions.
The Client and any associated retail consumers explicitly acknowledge that fees paid for fingerprint processing, LiveScan transmissions, and DNA buccal swab collections are fully consumed upon physical service execution at the facility. Because biological variables—including but not limited to friction ridge degradation, hyperhidrosis, scarring, age, or genetic sample limitations—dictate final processing capability, payment is assessed for the forensic manual labor applied, not a guaranteed administrative outcome. PBS provides no warranties of final approval from the FBI, State Clearinghouses, or external laboratory systems. All transactions are strictly non-refundable, and the user explicitly waives all rights to initiate a merchant chargeback.
